INSTALLATION SERVICE AGREEMENT

Effective Date: December 1, 2025

This Installation Service Agreement (“Agreement”) is entered into between TF Renovations, operated by 11141830 Canada Inc. (the “Company”), and the customer identified in the related work order or invoice (“Customer”).

By scheduling installation services, paying a deposit, signing a work order, or allowing installers to commence work, the Customer agrees to be bound by the terms of this Agreement.

 

1.      Scope of Work

1.1.  The Company agrees to provide installation services (“Services”) for the materials identified in the Customer’s invoice or work order.

1.2.  Services may include:

1.2.1.      tile installation (floor, wall, backsplash, shower)

1.2.2.      flooring installation (laminate, vinyl, hardwood, engineered flooring)

1.2.3.      mosaic/feature wall installation

1.2.4.      baseboard, trim, transitions, or thresholds

1.2.5.      demolition or removal (if included)

1.2.6.      other renovation-related services as specified in writing

1.3.  Only the work described in the written work order is included.
Any additional tasks requested by the Customer constitute extra work and require a signed Change Order.

 

2.      Materials

2.1.  Materials may be purchased from TF Renovations or supplied by the Customer.

2.2.  If materials are provided by the Customer:

2.2.1.      The Customer is responsible for quality, suitability, and quantity.

2.2.2.      The Company provides no warranty on Customer-supplied materials.

2.2.3.      Delays or defects caused by Customer-supplied materials are not the responsibility of the Company.

2.3.   If materials are purchased from TF Renovations, the Company’s Return Policy and Terms and Conditions of Sale apply.

 

3.      Measurements and Quantities

3.1.  The Customer is responsible for providing accurate measurements unless the Company performs a site measurement.

3.2.  If measurements provided by the Customer are incorrect, the Company is not liable for:

3.2.1.      material shortages

3.2.2.      excess materials

3.2.3.      delays

3.2.4.      additional labour costs

3.3.  Any additional material required due to inaccurate measurements will be purchased at the Customer’s expense.

 

4.      Site Conditions and Customer Responsibilities

4.1.  The Customer must ensure the installation site is:

4.1.1.      Accessible

4.1.2.      safe for workers

4.1.3.      free of debris, furniture, or obstructions

4.1.4.      adequately lit and ventilated

4.1.5.      compliant with local building codes

4.2.  The Customer must notify the Company of any known issues, including:

4.2.1.      uneven subfloors

4.2.2.      moisture issues

4.2.3.      mould, structural instability

4.2.4.      plumbing or electrical obstructions

4.2.5.      asbestos or hazardous materials

4.3.  If unsafe or unsuitable conditions are discovered, the Company may:

4.3.1.      stop work

4.3.2.      reschedule the job

4.3.3.      charge additional fees

4.3.4.      require written Change Orders

4.4.  Pets must be secured, and minors must be kept away from the workspace.

 

5.      Hidden Conditions

5.1.   The Company is not responsible for hidden defects or conditions discovered during the project, including but not limited to:

5.1.1.      rotted subfloors

5.1.2.      moisture penetration

5.1.3.      uneven foundations

5.1.4.      plumbing leaks

5.1.5.      electrical issues

5.1.6.      structural movement

5.1.7.      old construction deficiencies

5.2.   Additional work required to address hidden conditions will be billed separately.

 

 

6.      Workmanship Warranty

6.1.  The Company warrants labour for 12 months from the completion date, unless otherwise stated in writing.

6.2.   Warranty covers installation workmanship only.

6.3.  Warranty does not cover:

6.3.1.      defects in materials

6.3.2.      issues arising from improper subfloor preparation by others

6.3.3.      moisture damage

6.3.4.      cracking due to structure movement

6.3.5.      grout discolouration

6.3.6.      damage caused by Customer misuse or neglect

6.3.7.      normal wear and tear

6.3.8.      issues caused by installer instructions not being followed

6.4.  Warranty is void if:

6.4.1.      another contractor modifies the work

6.4.2.      the Customer performs repairs independently

6.4.3.      the Customer fails to maintain the installed materials properly

 

7.      Exclusions and Limitations

The Company is not responsible for:

7.1.   Tile lippage within industry tolerance.

7.2.   Colour or shade variation in natural stone, porcelain, or flooring.

7.3.   Failure of grout, caulking, or adhesives due to moisture or environmental conditions.

7.4.   Squeaky subfloors or structural flaws unrelated to installation.

7.5.   Damages to personal belongings not removed before installation.

7.6.   Any outcomes dependent on existing site conditions.

 

8.      Change Orders

8.1.  Any change in scope requested by the Customer must be approved in writing.

8.2.  Change Orders may result in additional charges and revised timelines.

8.3.  Verbal instructions are not binding unless documented and signed.

 

9.      Payment Terms

9.1.  A deposit may be required to schedule the installation.

9.2.  Full payment is due immediately upon completion unless otherwise stated.

9.3.  Failure to pay may result in:

9.3.1.      work stoppage

9.3.2.      late payment fees

9.3.3.      legal collection actions

9.4.  The Customer may not withhold payment for issues unrelated to the installation scope.

 

10.  Scheduling and Delays

10.1.                    Installation dates are estimates and may vary due to:

10.1.1.  material delays

10.1.2.  unforeseen site conditions

10.1.3.  weather

10.1.4.  subcontractor availability

10.2.                    The Company is not liable for project delays beyond its control.

10.3.                    If the Customer postpones or causes delays, rescheduling fees may apply.

 

11.  Liability and Indemnity

11.1.                    The Company is not liable for:

11.1.1.  indirect or consequential damages

11.1.2.  loss of use

11.1.3.  delays in project completion

11.1.4.  issues caused by Customer-supplied materials

11.1.5.  damage due to pre-existing structural problems

11.2.                    The Customer agrees to indemnify the Company against claims arising from:

11.2.1.  unsafe site conditions

11.2.2.  inaccurate information provided by the Customer

11.2.3.  actions of third-party contractors

11.2.4.  Customer negligence

 

12.  Access to Property

12.1.                    The Customer consents to allow the Company and its subcontractors access to the property for the purpose of performing installation.

12.2.                    Access must be continuous during working hours.

12.3.                    If access is denied or restricted, additional fees may apply.

 

13.  Completion and Acceptance

13.1.                    Upon completion, the Customer or their representative must inspect the work.

13.2.                    Completion is deemed accepted when:

13.2.1.  the Customer signs the completion form, or

13.2.2.  24 hours have passed without reporting major concerns, or

13.2.3.  the installed area is used by the Customer

13.3.                    Minor imperfections within industry standards do not constitute defects.

 

14.  Termination

14.1.                    The Company may terminate this Agreement if:

14.1.1.  the Customer fails to pay

14.1.2.  unsafe or illegal site conditions exist

14.1.3.  the Customer refuses to approve required Change Orders

14.2.                    The Customer must pay for all work completed up to termination.

 

15.  Governing Law

This Agreement is governed by the laws of the Province of Ontario and the applicable federal laws of Canada.
